Smart Contracts sind eine der wohl vielversprechendsten Anwendungen von Blockchain. Im Interview erkl\u00e4rt Prof. Ursula Sury am Beispiel eines Popkonzerts, was es damit auf sich hat. <\/strong><\/h2>\n\n\n\n

Ein Beispiel?<\/strong><\/p>\n\n\n\n

Sie bestellen online Tickets f\u00fcr ein Popkonzert. Die Bestellung ist der Vertragsabschluss. Sobald Ihre Zahlung eingegangen ist, l\u00f6st ein Smart Contract automatisch die Lieferung der Tickets aus. Smart Contracts eignen sich vor allem f\u00fcr standardisierte Massengesch\u00e4fte, wo sich repetitive Regeln abbilden lassen. Wichtig dabei ist, dass man sich auf den Input \u00abZahlung erfolgt\u00bb verlassen kann.<\/p>\n\n\n\n

Wie kommt ein Smart Contract zustande?<\/strong><\/p>\n\n\n\n

In unserem Szenario w\u00fcrde der Konzertbesucher mit dem Konzertveranstalter einen Smart Contract abschliessen. Der Ticketvermarkter w\u00fcrde als Intermedi\u00e4r wegfallen. Da die Vertragserf\u00fcllung automatisiert wird, m\u00fcssen Sie sich genau \u00fcberlegen, in welcher Reihenfolge die Leistungen erbracht werden sollen. <\/p>\n\n\n\n

Wie werden Smart Contracts gebaut?<\/strong><\/p>\n\n\n\n

Smart Contracts funktionieren \u00fcber \u00abif \u2026 then\u00bb Anweisungen. Dabei wird bestimmt, was erf\u00fcllt sein muss (if), damit eine Anweisung ausgef\u00fchrt wird (then). Wichtig ist, dass es nicht zu viele \u00abif \u2026 then\u00bb Anweisungen gibt und dass vor allem quantitative Informationen, wie etwa die Anzahl Konzert-Tickets erfragt werden. Individuelle W\u00fcnsche wie beispielsweise ein rollstuhlg\u00e4ngiger Platz in der N\u00e4he der B\u00fchne sind f\u00fcr Smart Contracts weniger geeignet.<\/p>\n\n\n\n

Welche Probleme k\u00f6nnen bei Smart Contracts auftauchen?<\/strong><\/p>\n\n\n\n

Zum einen gibt es die klassische Probleme wie Irrtum, Dissens oder Nichtigkeit. Allerdings d\u00fcrfte es wegen dem Zwang zum Durchdenken und Ausprogrammieren von ganzen Abl\u00e4ufen seltener zu Irrt\u00fcmern kommen. Zum anderen stellt sich die Frage, wer im Falle einer Vertragsverletzung haftet und wo der Vertragspartner eingeklagt werden kann. Ein weiteres Risiko steckt im Programmcode: Wenn ein Preis im Programmcode falsch hinterlegt w\u00fcrde (zum Beispiel 50 Rappen f\u00fcr ein Konzertticket statt 50 Franken), wird mit dem falschen Preis gerechnet und auch die Zahlungen so durchgef\u00fchrt. Den Code nachtr\u00e4glich zu \u00e4ndern ist zwar m\u00f6glich, jedoch sehr aufw\u00e4ndig.<\/p>\n\n\n\n

K\u00f6nnen Smart Contracts die Arbeit von Rechtsanw\u00e4ltinnen oder Notaren ersetzen?<\/strong><\/p>\n\n\n\n

Die Rolle von Notaren (Formvorschrift f\u00fcr wichtige Gesch\u00e4fte, Schutz der Parteien und der \u00d6ffentlichkeit) k\u00f6nnte mit Blockchain m\u00f6glicherweise schon ersetzt werden. Die Rolle der Anw\u00e4lte als Experten aber eher durch die KI-Technologie, zum Beispiel beim Analysieren oder Erstellen von Standardvertr\u00e4gen.<\/p>\n\n\n\n
